In Delaware, the law relating to farm labor can be found in 19 Del. C. § 1501. Pursuant to the section, if an employer of agricultural labor enters into a contract with an independent farm labor contractor engaging in the interstate recruitment of farm labor as defined in the federal Farm Labor Contractor Registration Act, 7 U.S.C. § 2041, that employer shall enter into such contract only after making reasonable efforts to assure that such independent farm labor contractor is in possession of a duly issued certificate of registration from the United States Secretary of Labor pursuant to the Farm Labor Contractor Registration Act. A good faith presentation to an employer of a prima facie valid certificate of registration under the Farm Labor Contractor Registration Act shall satisfy the obligations imposed upon such employer[i].
