New Mexico Farm Labor Laws

In New Mexico, the laws relating to farm labor can be found in N.M. Stat. Ann. § 50-4-31.  Pursuant to the section, an employer of agricultural laborers shall not require an employee to use a hoe that has a handle shorter than four feet while performing agricultural labor that includes weeding, thinning or hot-capping in a stooped, kneeling or squatting position for a commercial farming operation.  An employer who violates the above mentioned provision is guilty of a misdemeanor and shall be sentenced pursuant to the provisions of N.M. Stat. Ann. § 31-19-1.  Accordingly, where the defendant has been convicted of a crime constituting a misdemeanor, the judge shall sentence the person to be imprisoned in the county jail for a definite term less than one year or to the payment of a fine of not more than $ 1,000 or to both such imprisonment and fine in the discretion of the judge.
